Role play (see Part B, pp. 103-109).

Role 1. You are Tom Clark, an associate justice of the Supreme Court (see p.108). You believe in the importance of the role of the Supreme Court in the American political system. You are worried about the opinions that the Supreme Court can’t keep pace with the time and wrestle with modern challengers.

Roles 2,3.You are members of a human rights organization. You question the ability of the Supreme Court to cope with burning legal issues. You want Tom Clark to answer your questions on behalf of the Court. You call for:

- declaration of the death penalty unconstitutional (Role 2, pp.106-107);

- loosening the gun control laws and expanding the limits of self-defense (Role 3, pp.105-106).

Role 4. You are Linda Brown, whose constitutional rights were restored by a ruling of the Supreme Court (p.109). You protect the Court and its judges and praise its ability to react to the needs of the times. You raise the issue of segregation as an example of the Court’s response to the changes of public opinion and its concern for human rights.

Roles 5,6,7,8.You are ordinary citizens. You want to express your opinion in favor or against burning legal issues: high crime rate (pp. 103-104), arming citizens (pp.105-106), death penalty (pp.106-107). You must praise or criticize the Supreme Court and support human rights activists or Linda Brown.

Если права гражданина были нарушены, он имеет право обратиться в суд. Судебная ветвь власти независима и отделена от законодательной и исполнительной ветвей. Суды штатов, федеральные суды и Верховный суд США выносят решения, имеющие обязательную юридическую силу.

Несмотря на это, США печально известны из-за высокого уровня преступности. Суды не в состоянии сбалансировать права отдельного гражданина и общества в целом. Помимо прочего, это относится к правам подозреваемого в уголовном преступлении, которые нарушаются, несмотря на специальные процедуры допроса и возможность рассмотрения дела беспристрастным судом присяжных.

Смертная казнь как средство сдерживания преступности (устрашения) также вызывает вопросы у многих членов общества. Все это осложняет работу судов и сотрудников правоохранительных органов.

Так как тюрьмы переполнены заключенными, в их отношении используется условно-досрочное освобождение. Так преступники снова попадают на свободу. Поэтому многие обыватели выступают в пользу ослабления законов о контроле над оружием, чтобы бороться с преступностью. Суды присяжных обычно оправдывают тех, кто использовал оружие с целью самообороны.
