UNESCO

Chapter 1. General Provisions

Rule 1. Rules of Procedure

1. The present Rules of Procedure (hereinafter referred to as “Rules”) of the United Nations Educational, Scientific and Cultural Organization (hereinafter referred to as “the UNESCO”) shall be considered as adopted prior to the beginning of the Conference.

2. The President’s interpretation of the RANEPA Model United Nations Rules shall prevail.

Rule 2. Languages

1. English language shall be the only official and working language at the sessions of the UNESCO.

2. Speeches, statements, motions and points may be made only in English. No other language shall be allowed during the session.

Chapter 2. Participants

Rule 3. Powers of RANEPA MUN Participants

1. Powers of Delegates and Observers (hereinafter jointly referred to as “Representatives”), Chaperones and Guests shall be verified by the Secretariat during the registration process.

2. Representatives shall not abuse the present Rules.

3. At the UNESCO session a Representative shall have no right to speak in his or her personal capacity.

Rule 4. Delegates

1. One Delegate shall represent each Member State to the UNESCO.

2. The Delegates shall have a right to:

a. speak and vote on all matters under discussion;

b. submit Working Papers and Draft Resolutions;

c. draw up Amendments to a Draft Resolution and introduce them to the UNESCO;

d. raise Points and Motions.

3. The Delegates shall:

a. abide by the present Rules;

b. accord diplomatic courtesy to all other Participants;

c. respect the rulings of the President;

d. be present at all meetings.

Rule 5. Observers

International intergovernmental organizations and non-governmental organizations accredited with the UNESCO shall be represented by an Observer, who shall have a right to speak, but no right to vote. The right to speak shall be ranted by the President.

Rule 6. Motion to Deprive of the Right to Speak.

1. Should a Representative persistently violate the Rules of Procedure, the President or a Representative may arise a Motion to temporarily deprive the former of the right to speak for a certain period of time no longer than up to the end of the meeting.

2. This Motion is non-debatable and shall be immediately put to vote.

3. The President may rule the Motion out of order.

Rule 7. Chaperons and Guests

1. Chaperons and Guests shall have a right to attend the session of the UNESCO and be seated at the specially designated places.

2. The Chaperons and Guests shall in no way participate in the session of the UNESCO.

Rule 8. Violation of Rules of Procedure

1. The violation of the present Rules is prohibited.

2. Participants violating the present Rules shall be immediately called to order by the President. In case of persistent violation the President shall raise a Motion to temporarily deprive the Delegate of the right to speak.

Chapter 3. President

Rule 9. President

The President is appointed by RANEPA MUN Administration.

Rule 10. Powers of President

1. The President shall preside over the sessions of the UNESCO. The President shall act in an equitable and objective manner to ensure the effective functioning of the UNESCO.

2. The President shall:

a. Ensure the observance of the present Rules;

b. Conduct a Roll Call to establish presence at the beginning of each meeting and at any other time if required;

c. Declare the opening and closing of each meeting;

d. Have complete control of the proceedings in the UNESCO;

e. Introduce Procedural Motions;

f. Direct the discussion at meetings;

g. Initiate the period and announce the deadline for submitting Working Papers and Amendments;

h. Open and close the Speakers List;

i. Accord the right to speak;

j. Maintain order during the meetings;

k. Put questions to vote;

l. Announce the results of voting.

3. The President shall have the right to rule out of order points and motions raised by Representatives, unless otherwise provided in the present Rules.

4. The President may give rulings on matters left in the present Rules to his or her discretion. He or she may also decide on any other matter regarding the conduct of the meeting that is not envisaged in the present Rules.

5. Rulings of the President are subject to appeal. The Motion to Appeal the Ruling of the President requires the support of a second Representative and is non-debatable. An affirmative vote of 2/3 of Representatives is required for the Motion to Appeal the Ruling of the President to pass.

6. The President shall be impartial. He or she shall refrain from speaking on the substance of the matters under discussion except when it is necessary to ensure the effective functioning of the Council.

Chapter 4. Secretariat

Rule 11. Secretariat

An Expert and Secretaries shall represent the Secretariat in the UNESCO. Other Members of the Secretariat may also be present at the UNESCO meetings and speak on the matters that are within their competence provided the President yields the floor to them. The President shall also exercise the general management of the activities by Secretariat Members in the UNESCO.

Rule 12. Expert

1.The Expert shall prepare a report on the agenda and participate in the UNESCO meetings.

1. The Expert’s evaluation of all Working Papers and Amendments to the Draft Resolution shall be conducted to test the documents’ conformity with the general Working Paper execution provisions and their compliance with the international law and previous UN Resolutions.

2. The Expert’s rulings are not subject to appeal.

3. The President may at any time ask the Expert to clarify a substantial or legal point regarding the matter under discussion of the UNESCO.

4. During the debate and the discussion of Working Papers and Amendments to the Draft Resolution any Delegate may introduce a Question to the Expert in order to clarify a substantial point regarding the matter under discussion. Such Question shall be submitted to the President in written form. After that the President may decide to give the floor to the Expert to answer the Question otherwise the Expert shall give the answer in written form.

Rule 13. Secretaries

The Secretaries shall perform their duties under the direct supervision of the President. They shall receive, print and circulate documents, reports and resolutions, conduct the counting of votes and at the request of the President perform all the work that may be required for the good functioning of the UNESCO.

Chapter 5. Conduct of Business

Rule 14. Roll Call

1. A Roll Call shall be conducted in the English alphabetical order prior to the beginning of the session in order to establish the quorum.

2. When called upon by the President the Delegate shall raise the placard with the name of his or her country and say “Present” or “Present and voting”.

Rule 15. Presence

1. The President can declare the meeting open and permit the debate provided at least half of the registered delegations of the UNESCO are present.

2. Any matter can be put to vote or decided upon provided a simple majority of the registered Delegates of the UNESCO is present.

Rule 16. Debate and Caucus

1. The session of the UNESCO shall be conducted in three forms:

a. formal debate

b. moderated Caucus

c. unmoderated Caucus.

2. During the whole session Delegates cannot leave the room without the President’s permission.

Rule 17. Formal Debate

1. Formal Debate applies when the Delegate presents their position statements, discuss Working Papers, Amendments and proposals for the Final Document, unless otherwise resolved by the UNESCO.

2. Prior to the Formal Debate the President shall declare the opening of the debate and open the List of Speakers. Delegates wishing to speak raise their placards with the names of the countries they represent. The President makes the List of Speakers. A Delegation has the right to ask to speak at the end of the Speakers List.

3. During the Formal Debate:

a. the President shall grant the right to speak in accordance with the

List of Speakers;

b. the President shall keep the Speakers List and maintain the order

of speeches;

c. the Delegates shall be present in the room;

d. the Representatives shall have a right to introduce procedural Motions and ask questions as provided for in Chapter 6 of the present Rules.

e. time limits shall be set for speaking and debating.

Rule 18. Moderated Caucus

1. Moderated Caucus shall be used for informal debate.

2. During Moderated Caucus;

a. no List of Speakers shall be kept;

b. the Delegations shall speak and debate out of the format of Formal Debate;

c. the right to speak shall be granted by the President to the Representatives at their request.

3. A Delegate may at any time, when the floor is open but not during speeches or voting, introduce a Motion for Moderated Caucus. The Delegate shall rise when called by the President to explain the purpose of the Motion and propose the time for the Caucus.

4. The Motion for Moderated Caucus requires support of another Delegate, is non-debatable and shall immediately be put to vote. A majority of Delegates is required for the Motion for Moderated Caucus to pass.

Rule 19. Unmoderated Caucus

1. Unmoderated Caucus is used for negotiations and consultations without

observing the present Rules.

2. A Delegate or the President may at any time, when the floor is open but not during speeches or voting, introduce a Motion for Unmoderated Caucus. The Delegate shall rise when called by the President to explain the purpose of the Motion and propose the time for the Caucus (the time for the Caucus shall not exceed 20 minutes).

3. The Motion for Unmoderated Caucus requires the support of anotherDelegate, is non-debatable and shall immediately be put to vote. A simple majority of Delegates present is required for the Motion to pass.

Rule 20. Time limit and Conduct of Speeches

1. Time limits and conduct of speeches shall establish:

a. the order of debates on the question on the agenda, unless otherwise provided for in the present Rules;

b. the total time for discussing a substantial matter;

c. the number of speeches and the time limits for speeches and questions to the Speaker;

d. the necessity to conduct debate on the issue under consideration.

2. The time limit and the conduct of speeches shall be set at the beginning of the session and shall be subject to change during the Formal Debate by a simple majority of Representatives present and voting.

Rule 21. Speeches

1. A Delegate wishing to speak shall ask the President to grant him or her the floor by raising the placard.

2. When speaking on different procedural and substantial matters the Representatives shall observe the time limit and the present Rules.

3. If any time remains, the Speaker has the right to declare him- or herself either open or closed for questions. The Representative may refuse to answer a question or yield the right to answer the question to another Delegate.

Rule 22. Conduct of Debate

1. Debate on the issue in question shall be conducted provided no consensus has been reached on substantial matters (i.e. adopting the Draft Resolution, incorporating Amendments, and voting on the final Resolution of the UNESCO).

2. A Representative wishing to speak shall ask the President to grant him or her the floor by raising the placard. The President shall establish and keep the Speakers List.

Chapter 6. Resolution

Rule 23. General Debate

At the beginning of the meeting of the UNESCO a General Debate on the agenda shall be held. During the course of the Debate, each Delegate shall have the right to address the UNESCO with a position statement.

Rule 24. Working Papers

1. A Working Paper is a document that reflects the position on the issue under discussion of a group of countries (thereinafter referred to as “sponsors”).

2. Any member of the UNESCO can become a sponsor of a Working Paper and submit it to the President.

3. The document can be submitted to the President provided that it is sponsored by at least seven Delegates.

4. The maximum number of sponsors is not limited. A Delegation may not at the same time be a sponsor of more than one Working Paper.

Rule 25. Submitting Working Papers

1. Upon finishing the General Debate the President announces the deadline for submitting Working Papers.

2. The document shall be approved if the President registers it and if it passes the Expert’s examination. The Expert shall verify the documents’ conformity with the general Working Paper execution provisions and their compliance with the international law and previous United Nations resolutions.

3. An Observer cannot be a sponsor of a Working Paper.

4. After a Working Paper has been registered by the President and assigned a number, a Formal Debate on the Working Paper can be held.

5. Working Papers shall have precedence in order of their submission, unless otherwise decided by the UNESCO. More than one Working Paper may be on the floor at any time.

Rule 26. Debate on Working Papers

1. Discussion of a Working Paper includes:

a. introduction of the Working Paper by one of the sponsors;

b. debate on the Working Paper (the number of speeches in favor and against shall be set by the President).

2. The same procedure shall be used for Debates on all Working Papers that have been submitted and approved.

Rule 27. Voting on Draft Resolution

1. Adoption of the Working Paper requires a simple majority of the Delegates present and voting.

2. Upon finishing the Debates on all the documents, the Working Papersshall be put to vote in the order they have been discussed by the UNESCO.

3. From the moment of adoption by a majority of Delegates present and voting, the accepted Working Paper is referred to as Draft Resolution

and the rest of the Working Papers are not voted upon.

Rule 28. Amendments

1. An Amendment is a Motion that adds to, deletes from or modifies any part of a Draft Resolution.

2. An Amendment shall be submitted in the following form:

a. it is printed or written in a legible handwriting on a separate sheet of paper;

b. the type of an Amendment (addition, deletion or revision) is clearly stated;

c. there is reference to the sponsor of an Amendment or to the Delegate that will introduce it (if there are two or more sponsors);

d. an Amendment has passed the Expert’s examination.

Rule 29. Consideration of Amendments in Order of Priority

1. The UNESCO shall consider the Amendments to the operative clausesfirst. Upon finishing with these Amendments, the UNESCO can consider the Amendments to the Preamble, unless otherwise decided by the UNESCO.

2. If two or more Amendments to a Draft Resolution are proposed,

Amendments to the first operative clause shall be voted upon first and so on to the last clause of the Draft Resolution. Amendments proposing to add a new pointshall be voted upon last, but still prior to Amendments to the Preamble.

3. If two or more Amendments to a clause are proposed, the UNESCO shall first vote on the Amendment furthest removed in substance from the original proposal and then on the Amendment next furthest removed until all Amendments have been put to the vote, but when an Amendment adds to or deletes from the text of a Draft Resolution, that Amendment shall be voted on first.

4. The Expert shall observe that an Amendment is in conformity with the meaning and purposes of the Draft Resolution.

5. Grammatical, spelling and formatting errors in the Draft Resolution shall be corrected by the Secretariat without a vote.

Rule 30. Debate on Amendment Debate on an Amendment shall be conducted in the following way:

1. A Sponsor introduces the Amendment;

2. Prior to the vote on an Amendment, the UNESCO shall consider number of Speakers in favor and opposed to each Amendment and shall give each of them limited time to present their position to the UNESCO (the number of Speakers and time limits are set by the President at his or her discretion);

3. An Amendment requires a simple majority of the Delegates present to pass.

Rule 31. Amendment to Amendment

1. An Amendment to an Amendment is a Motion that adds to, deletes from or revises any part of an Amendment.

2. An Amendment to an Amendment can be introduced orally during the course of discussing the initial Amendment but before the voting on the latter has commenced. The proposing party should clearly explain its point. Debate on Amendments to Amendments is conducted separately after the evaluation of the latter by the Expert.

3. Introducing an Amendment to an Amendment after voting on the initial

Amendment is not in order.

4. If several Amendments to an Amendment have been introduced, they shall be discussed in the order they have been submitted. After voting on an Amendment, the UNESCO returns to the Debate on the initial Amendment. Adoption of an Amendment to an Amendment does not mean adoption of the initial Amendment.

5. An Amendment to an Amendment to an Amendment is out of order.

Rule 32. Friendly Amendment to Amendment

1. If approved by the Sponsors of the initial Amendment, an Amendment to an Amendment shall be considered friendly.

2. Friendly Amendments to Amendments are immediately incorporated into the initial Amendment without a vote being cast. After that the UNESCO returns to the discussion on the altered initial Amendment.

Rule 33. Withdrawal of Amendment

An Amendment (or an Amendment to an Amendment) may be withdrawn by its Sponsors at any time before voting on it has commenced.

Rule 34. Resolution

1.When the list of Amendments has exhausted, the UNESCO shall vote on the Draft Resolution including all Amendments incorporated in it.

1. Before the vote the Secretariat shall supply the Delegates with the final text of the Draft Resolution.

2. If supported by a simple majority of the Representatives present the Draft Resolution becomes the Resolution of the UNESCO.

3. The Resolution shall have no Sponsors and shall be considered the result of the work of the UNESCO.

Chapter 7. Points and Motions in Order of Priority

Rule 35. Precedence of Points

Points shall be considered in the following order of preference:

1. Point of Personal Privilege;

2. Point of Order;

3. Point of Parliamentary Inquiry;

4. Question on Voting;

5. Question to the Expert;

6. Procedural Motion;

7. Right of Reply.

Rule 36. Point of Personal Privilege

1. A Delegate may at any time introduce a Point of Personal Privilege in order to remove personal discomfort, which impairs his or her ability to participate in the proceedings. The Delegate shall rise when called by the President and explain the grievance.

2. A Representative who raised a Point of Personal Privilege is not allowed to talk on the matter in question.

Rule 37. Point of Order

A Delegate may raise a Point of Order if a rule of procedure is not properly observed by a Delegate or by the President. The President will rule on the validity of the point. A Delegate rising to a Point of Order may not comment on the topic of discussion. A Point of Order can be ruled out by the President. This point may not interrupt the Speaker.

Rule 38. Point of Parliamentary Inquiry

1. A Representative may, at any time when the floor is open, but not during voting, introduce a Point of Parliamentary Inquiry in order to clarify a technical point regarding the Conduct of Business of the UNESCO. The President shall immediately decide on the Point in accordance with the present Rules.

2. A Representative who raised the Point is not allowed to talk on the matter in question.

Rule 39. Question on Voting

1. The voting procedure can be interrupted only with a Question on Voting should the Delegate believe that the voting procedure is not observed properly. The question can be raised provided that the Delegate believes there has been miscalculation of the votes.

2. After a Question on Voting has been decided upon, the Delegates shall re-vote.

3. Should the President deem that no miscalculation has taken place during the voting procedure he or she can rule the Question out of order.

Rule 40. Question to the Speaker

1. Should any time remain and should the Speaker declare him- or herself open for questions, a Representative shall have the right to ask the former a question on the matter under discussion.

2. The President may rule a Question out of order should he deem the Question irrelevant.

Rule 41. Question to the Expert

1. A Delegate may at any time introduce a Question to the Expert in order to clarify a substantial point regarding the matter under discussion of the Council. The Question shall be submitted to the Expert in written form.

2. The President may yield the floor to the Expert to answer the Question. Otherwise the Expert shall answer the Question in written form.

3. The President may rule a Question out of order should he deem the Question irrelevant.

Rule 42. Right of Reply

1. A Representative can use the Right of Reply should another Representative impugn his or her personal dignity or national integrity.

2. The Right of Reply shall be requested in written form right after the impugning Representative’s speech.

3. The Request shall contain the reasons for giving the wronged Representative a Right of Reply.

4. The President can rule a Right of Reply out of order, this ruling not being subject to appeal.

5. If a Right of Reply is granted, the wronged Representative may speak during one minute.

6. A Right of Reply to a Right of Reply is out of order.

Chapter 8. Procedural Motions in Order of Priority

Rule 43. Precedence of Procedural Motions

Procedural Motions shall be considered in the following order:

1. Motion to Adjourn the Meeting;

2. Motion to Suspend the Meeting (to get acquainted with the documents, to take a rest, etc. A Delegate shall explain the purpose of the Motion and propose a time limit):

3. Motion to appeal to the ruling of the President;

4. Motion for an Unmoderated Caucus;

5. Motion for a Moderated Caucus;

6. Motion to temporarily deprive a Delegate of the Right to Speak (the

Motion can be raised by the President and needs 2/3 affirmative votes of the Delegates present to pass. A Delegate can be deprived of the right to speak for a period of time that shall be no longer than up to the end of the meeting);

7. Motion to return to Debate (on the matter, discussion on which has been suspended);

8. Motion for closure of Debate (to terminate all discussion on a particular matter and immediately vote on the matter in question);

9. Motion to Reconsider a Question (to re-vote on a matter);

10. Motion to extend/limit the Speaker's time or the number of speeches;

11. Motion for a Roll Call Vote. The Representatives have a right to raise Procedural Motions, except for Motion to Adjourn the Meeting. Only the President and the Vice-President can raise this Motion.

Rule 44. Consideration of Procedural Motion

The UENESCO shall consider each Motion in the following order:

1. A Motion can be raised by any Delegate at any time when the floor is open, but not during speeches and voting;

2. A Motion requires the support of at least one more Representative;

3. Consideration of all Motions, but for the one to Adjourn the Meeting, shall not require speeches “in favor” and “against” the Motion;

4. After discussing the Motion it is put to vote;

5. In case no objections to a Motion are raised, such decision shall be considered adopted.

Chapter 9. Voting

Rule 45. Types of Voting

1. The decisions of the UNESCO on procedural matters can be adopted:

a. by consensus (in case no objections are raised);

b. by a simple majority of the Delegates present;

c. by a qualified majority of 2/3 of the Delegates present.

2. The decisions of the UNESCO on substantial matters can be adopted:

a. by consensus (in case no objections are raised);

b. by a simple majority of the Delegates present;

c. by a qualified majority of 2/3 of the Delegates present.

Rule 46. Voting

1. In case of exhaustion of the List of Speakers or when a Motion for

Closure of Debate passes, Resolutions, and Unfriendly Amendments to

Amendments on the floor shall automatically be put to vote.

2. The Delegates shall vote by raising their placards, unless otherwise decided by the UNESCO.

3. For matters of great importance a Delegate may request a Roll Call vote.

a. the Request may be put to vote;

b. a Roll Call vote takes place according to the English alphabetical order of the names of the Member States present in the UNESCO. The President shall subsequently call the name of each State. The Delegate shall reply “Yes”, “No” or “Abstain”.

c. in Roll Call vote, a State may pass once, but then must vote in the affirmative or negative.

d. upon completion of voting a Delegate may request the right to explain his or her vote on the matter. The President may rule this request out of order, the decision not being subject to appeal. The speaking time shall not exceed one minute.

e. there shall be no Roll Call vote on procedural matters.

4. Delegates cannot abstain when voting on procedural matters. Delegates having stated “present and voting” cannot abstain when voting on any matters.

5. During voting procedure Delegates shall strictly refrain from communicating with each other. The voting procedure must not be interrupted except to raise a Point in the connection with the actual process of voting.

Rule 47. Required Majority

1. Motions 3, 6, 7 and 9 (Rule 43) require a qualified majority of 2/3 of the

Delegates present to pass.

2. Motions 1, 2, 4, 5, 8, 10 and 11 (Rule 43) require a simple majority of the

Delegates present in order to pass.

3. Working papers, Amendments, Amendments to Amendments and

Resolution require simple majority of the Delegates present in order to pass.
