The Problem of Punishment
What should be the ethical punishment for unethical action?
1. Should we punish at all? Yes, because the society with a system of punishment will have less crime than the society without such a system.
2. What is an ethical size of punishment? An ancient wisdom (Code of Hammurabi, Torah etc.) Eye for eye, life for life…

Ford Pinto In May of 1968 the Ford Motor Company introduced a subcompact car Pinto. The automobile was designed on an accelerated schedule and had a defective fuel system that led to the explosion of the car after a slight road accident…
Actually, Ford could change the design -- this would have cost $11 per car and result in 180 less deaths. But it was economically ineffective: • COST: $11 per unit cost applied to 11 million cars and 1.5 million trucks results in an overall redesign cost of $137 m. • BENEFITS: 180 burn deaths, 180 serious burn injuries, and 2,100 burned vehicles demanded for compensations of $200,000 per death, $67,000 per injury, and $700 per vehicle. The total sum of compensation was $49.5 m.
So, it was an economically optimum solution to kill 180 and injure 180 people.
